1. Acceptance of Terms
These Terms and Conditions govern all contracts for the sale of goods through the James Freeman Jewellery website (jamesfreemanjewellery.co.uk). By accessing our website or placing an order, you agree to be bound by these Terms in full. If you do not agree, you must not use our website.
We may update these Terms from time to time. Continued use of the website constitutes acceptance of the updated Terms. Customers are advised to print or save a copy for future reference.
Our online store is hosted by Squarespace, which provides the e‑commerce platform enabling us to sell our products and services.
2. Product Description & Care
Handmade Nature
All jewellery is handmade. As a result, slight variations in colour, texture, finish, and appearance from website images are expected.
No two pieces will be identical. By purchasing, you acknowledge and accept these natural variations.
Materials & Gemstones
Gemstones may vary in colour, pattern, and inclusions.
Metal finishes (e.g., sterling silver) may naturally tarnish over time; this is not considered a fault.
Colour Accuracy
While we make every effort to display colours accurately, variations may occur due to screen settings.
Sizing
Customers are responsible for ensuring correct ring, bracelet, or necklace measurements. Guidance is available upon request.
Care Instructions
Proper care is essential. Avoid exposure to water, perfumes, lotions, chemicals, and impact.
Damage caused by improper care or wear and tear is not considered a manufacturing fault and may void your rights under these Terms.
3. Pricing, Payment & Contract Formation
Pricing
Prices are listed in GBP (£) and include VAT where applicable.
We reserve the right to amend prices or correct errors at any time.
Payment
Payment must be made in full at the time of ordering.
You confirm that the payment method used is yours or that you are authorised to use it.
Contract Formation
Your order constitutes an offer to purchase.
A legally binding contract is formed only when we dispatch your order and send a shipping confirmation email.
We may cancel an order (and provide full refund) before dispatch if:
a pricing or stock error occurs,
payment cannot be verified,
fraud is suspected,
we are unable to fulfil the order.
4. Delivery & Risk
Dispatch
Stock items are typically dispatched within five working days.
Made‑to‑order or bespoke items may have longer lead times, which will be stated on the product page.
Delivery
If we fail to deliver within 30 days of your order, you have a statutory right to cancel for a full refund.
Delivery times are estimates and may be affected by events outside our control (e.g., postal delays, strikes, severe weather).
Customer Responsibilities
You are responsible for providing accurate delivery information. We are not liable for losses arising from incorrect details.
Risk of Loss
Risk passes to you once you (or a person nominated by you) take physical possession of the goods.
5. Returns & Refunds
Right to Cancel (Consumer Contracts Regulations 2013)
For online purchases of stock items, you have 14 days from receiving your order to notify us in writing (email) that you wish to cancel.
You then have a further 14 days to return the item.
Return Requirements
Items must be returned:
unworn (other than trying on),
in original condition,
with all packaging, accessories, and the original receipt.
Returns must be sent using a tracked, insured service at your own cost.
Refunds
Once the item is received and inspected, we will refund:
the cost of the jewellery, and
the original basic standard delivery charge.
If you selected an upgraded delivery method, only the standard rate will be refunded.
We may deduct an amount for diminished value if the item has been handled beyond what is necessary to establish its nature, characteristics, or functioning.
Exclusions
Earrings: Non‑returnable for hygiene reasons unless faulty.
Bespoke/Custom Orders: Non‑refundable. This includes personalised, engraved, custom‑sized, or made‑to‑order items.
Faulty Goods (Consumer Rights Act 2015)
Within 30 days: You are entitled to a full refund if the item is faulty.
After 30 days: We will repair or replace the item. If this is not possible within a reasonable time, you may be entitled to a full or partial refund.
Faults caused by misuse, accidents, or failure to follow care instructions are not covered.
6. Allergies
Customers are responsible for checking metal allergies or sensitivities before purchase. We cannot accept returns for allergic reactions unless the item was misdescribed.
7. Intellectual Property
All images, designs, logos, and written content on this website are the property of James Freeman Jewellery. They may not be copied, reproduced, or used commercially without prior written permission. Unauthorised use may result in legal action.
8. Website Availability & Errors
We aim to keep the website accurate and available at all times, but we do not guarantee uninterrupted access. Content may change without notice. We are not liable for losses arising from website downtime or errors.
9. Indemnification & Limitation of Liability
You agree to indemnify James Freeman Jewellery against claims arising from your misuse of the website.
To the fullest extent permitted by law:
we are not liable for indirect, consequential, or punitive damages,
our total liability for any claim shall not exceed the price paid for the product.
Nothing in these Terms limits liability for:
death or personal injury caused by our negligence,
fraud or fraudulent misrepresentation,
any rights you have under UK consumer law.
10. Data Protection
Your personal data is processed in accordance with our Privacy Policy and UK GDPR. This includes processing by trusted third‑party providers such as Squarespace and payment processors.
11. Force Majeure
We are not liable for delays or failure to perform our obligations due to events beyond our reasonable control, including natural disasters, postal strikes, pandemics, or supply chain disruptions.
12. Governing Law & Jurisdiction
These Terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
